Preamble

We are pleased to welcome you to our website www.wedarelab.com (hereinafter referred to as the “Site”).

These general conditions of use (hereinafter “the T&Cs”) exclusively govern the operation of the Site, at the time of its discovery and/or the filing of the registration form to apply for the WeDare Lab Program (hereinafter “the Program “).

The fact of completing and sending a registration form, implies the full and unreserved acceptance of the candidate (hereinafter “the Candidate(s)”) to these T & Cs, to the exclusion of all other conditions present in leaflets, catalogs, media, etc., issued by WeDareLab.

Any contrary condition set by the Candidate will therefore, in the absence of express acceptance, be unenforceable against WeDareLab, regardless of when it may have been brought to its attention. The fact that WeDareLab does not take advantage at any given time of any of these T&Cs cannot be interpreted as a waiver to take advantage of them later.

WeDareLab strives to ensure to the best of its ability the accuracy and updating of the information published on the Site, and reserves the right to correct the content at any time and without notice.

If a condition were to be lacking, it would be considered to be governed by French customs and laws in force for online application submission.

Article 1: object

These T&Cs govern the operation of the Site, namely in particular the presentation of the Program and the receipt of application forms for said Program.

 

Article 2. How to apply for the Program?

Each year, WeDareLab will open two sessions during which Candidates for registration must complete the dedicated Form, before a deadline.

Candidates whose Forms have been selected will be invited to present their project during an oral session, on a date informed by WeDareLab.

To be eligible for the Program, the Candidate must be of legal age and meet the conditions specified on the Site and in the Form.

Each Candidate undertakes not to include any incorrect or misleading information in the Form.

Otherwise, WeDareLab will be free to reject any Form that it deems incorrect or fraudulent.

 

Article 3. Cancellation of candidacy

Each Candidate may, if they wish, cancel their Application.

To do this, he must notify WeDareLab via the “Contact Us” link.

 

Article 4. The choice of WeDareLab

WeDareLab will select the Candidates selected for the corresponding Support Program, which will begin on the date indicated on the Site.

Beforehand, each Candidate must sign a support framework contract with WeDareLab, which will define the terms of the partnership.

Article 6. Authorization

Any Application for the Program implies, for the benefit of WeDareLab, the authorization to publish on all present and future supports and media and in any advertising and promotional event related to the said Program, the name of the Candidates selected, without this use being able to give right to the payment of any compensation, other than the contract concluded in fine between the Candidates selected and WeDareLab.

 

Article 7. Personal data

The controller of your personal data is:

WEDARELAB, simplified joint-stock company with a single shareholder, company of the ETAM Group, registered with the RCD of Nanterre under number 902 215 425, located in CLICHY (92110)

Personal data is any information relating to an identified or identifiable natural person.

The names and contact details (email and telephone number) of Candidates may be subject to computer processing by WeDareLab.

The processing of your personal data aims to allow the examination of the various applications for the WedareLab Program and is based on your consent as a legal basis.

Data concerning unsuccessful Candidates will be deleted by WeDareLab within 2 years after the last contact.

The data concerning the selected Candidates will be kept for the duration of the partnership with WeDareLab and deleted within 5 years, following the end of the said partnership.

In accordance with Regulation (EU) 2016/679 dated April 27, 2016 relating to the protection of personal data, Candidates have at any time a right of access, rectification, deletion of personal information concerning them, as well as the possibility of opposing the processing of this data.

To do so, all they have to do is make a request, specifying their contact details and sending a copy of their identity document, by email privacy@etam.fr.

WeDareLab has endeavored to put in place reasonable precautions to preserve the confidentiality, integrity and availability of the personal data processed and to prevent it from being distorted, damaged, destroyed or accessed by unauthorized third parties. Technical and organizational security measures have been implemented for this purpose.

However, WeDareLab does not control all the risks related to the operation of the Internet and draws the attention of Internet users to the existence of possible risks inherent in its use and operation.

WeDareLab attaches the greatest importance to the protection and security of its information systems. Tools have been put in place to allow WeDareLab to detect any security breaches. These tools can incidentally lead to access to personal data by security teams. These data will be collected and processed for the exclusive purposes of managing these faults and in compliance with the applicable regulations on the protection of personal data.

A cookie is a text file that can be saved in a dedicated space on the hard drive of your electronic equipment when consulting an online service, using your browser software. A cookie file allows its issuer to identify the terminal in which it is registered, during the period of validity or registration of said cookie.

WeDareLab only uses tracers strictly necessary for the provision of an online communication service benefiting the user and aimed at allowing or facilitating the transmission of communication by electronic means.

 

Article 8. Non-Disclosure Agreement

WeDareLab considers as confidential and undertakes not to disclose to third parties, against financial counterpart or for free of charge, and in any form whatsoever, any received Information of any kind, more specifically all data mentioned in the registration form to apply for the WeDareLab program.

WeDareLab undertakes to limit, within its organization, the circulation of such Information only to persons whose activity justifies such disclosure and to warn them about their confidential nature.

 

Article 9. Liability

WeDareLab cannot be held responsible for:

– for any interruption of the Site, occurrence of bugs, damage resulting from fraudulent intrusion by a third party leading to a modification of the information made available on the Site,

-in the event of a computer virus, failure of telecommunications systems or any other act of force majeure, making it impossible to temporarily access the Form or even the Site.

 

Article 10. Intellectual property

Use of the Site is reserved for strictly personal use. In accordance with the laws governing the ownership of literary and artistic rights or other similar rights, this Site and all elements, brands, designs, models, logos, graphics, etc. found on this Site as well as their compilation, are the exclusive property of WeDareLab, its affiliated companies and/or the ETAM Group.

WeDareLab reminds that any reproduction, use or modification, partial or total, of any element of the Site, is strictly prohibited, except with prior, special and express authorization on its part.

Consequently, WeDareLab may take legal action, in particular for infringement, against anyone who, directly or indirectly, infringes its rights.

 

Article 11. Modification of the General Conditions of Use

Given the possible evolutions of the Site, WeDareLab reserves the right to adapt or modify these General Conditions of Use at any time. They may, where appropriate, be brought to the attention of Candidates by online modification.

 

Article 12. Evidence

The computerized registers kept in the information systems of WeDareLab and its partners under reasonable security conditions, will be considered as proof of communication of the data/information transmitted by the Candidates.

 

Article 13. Applicable law – Disputes

These T&Cs are subject to French law. The language used is French. In the event of a dispute, the French courts will have sole jurisdiction.
